Plan Ahead & Protect What Matters Most

Estate planning can be daunting and complex. There are many facets to what you and your loved ones may need to be protected in the event of your death. Some general tools in estate planning are wills, trusts, health care directives and a durable power of attorney.

Estate Planning Tools

Wills For Basic Planning

A will can cover basic needs like organizing your assets and guardians for your children.

Trusts For Asset Transfer

A trust can allow you to pass assets to your loved ones outside of a lengthy probate process.

Health Care Directives

A health care directive can outline your wishes in the event of an illness or you otherwise being incapacitated.

Power Of Attorney

A durable power of attorney allows someone to make important decisions on your behalf when needed.

Why Proper Legal Planning Matters

Wills and estate planning documents require the use of precise and unambiguous formal legal language to ensure the person’s wishes for their belongings are clear. You will need to clearly identify all beneficiaries (those who benefit from your death), consider contingency plans in the event a current beneficiary predeceases you, and use precise language and legal descriptions for property. Failure to properly take these steps can result in lengthy and costly disputes.

Understanding Your Estate

Your estate is considered to be the sum of everything you own (personal property, real estate, bank accounts, etc.) minus your debts and any outstanding obligations.

Assets Not Subject To Probate

Probate

It is required if the deceased owned Nevada real estate or had assets exceeding $20,000. The process will vary depending on the size of the estate.

Types Of Probate

Small Estate Administration

For a small estate under $100,000 (or $25,000 for a non-spouse heir), an Affidavit Set Aside is typically used to transfer assets efficiently without a formal probate process.

Summary Estate Administration

For estates between $100,000 and $300,000, Summary Administration allows assets to be handled through a simplified probate process with reduced court involvement and faster resolution.

Full Estate Administration

For estates exceeding $300,000, a full probate process is required where a representative manages assets, settles debts, and distributes property to beneficiaries under court supervision.
