Understanding Juvenile Criminal Cases

It is important to have an attorney that has experience practicing in the Juvenile Courts when your child is charged with a crime. In Nevada the Juvenile Courts are set up to help your child, not punish him or her. However, this also means that the rules of law that apply to adult cases do not apply to juvenile cases.

Why Experience Matters

Juvenile Court System

The Juvenile Courts are designed to help your child, not punish him or her, but the legal process is different from adult criminal cases.

Different Legal Rules

The rules of law that apply to adult cases do not apply to juvenile cases, making experienced legal representation essential.

Experienced Representation

You need an attorney that is experienced in practicing in the juvenile system to properly represent and protect your child.

Legal Process

Juvenile Case Process

If a child is charged with a juvenile crime, your child is not entitled to bail. He or she may be turned over to the parents’ custody if after a detainer hearing the court decides that it must detain your child in custody.

After the petition for delinquency (Complaint in Adult Court) is filed, the case will be set for a trial date. If a plea agreement cannot be worked out with the District Attorney prosecuting the case, the case will move to trial in front of the Judge.

Because breathalyzers do not detect marijuana, when pulled over for suspected marijuana use, drivers are instead to submit to a blood test.   Be aware, new laws effective January 1, 2026 (AB4) have expanded to strictly apply to felony DUI cases, meaning in serious cases involving injury or death, the stricter marijuana impairment standards now fully apply.
